In today's competitive market, your brand identity is one of your most valuable assets. Without legal protection, your business names, logos, and slogans are vulnerable to infringement. This guide explains the trademark registration process in Nepal and why it's critical for local and international brands operating in Kathmandu.

1. What can be Registered as a Trademark in Nepal?

Under the Patent, Design, and Trademark Act, 2022 (1965), a trademark can include:

  • Business Names: Unique names that identify your products or services.
  • Logos & Symbols: Distinctive graphical designs.
  • Slogans: Short, memorable phrases associated with your brand.

2. The Trademark Registration Process

Registering a trademark in Nepal takes between 9 to 12 months and involves several distinct phases:

Phase 1: Search & Application

Before filing, our legal team conducts a "Trademark Search" at the Department of Industries (DOI) in Kathmandu. This ensures your brand doesn't conflict with existing registered marks. Once cleared, we file the official application.

Phase 2: Examination by DOI

The Department of Industries examines the application based on uniqueness, legality, and potential offensiveness. If the application is accepted, it is scheduled for publication.

Phase 3: Publication in the Industrial Gazette

The trademark is published in the official gazette. This starts a 90-day opposition period where anyone can file a complaint against the registration.

Phase 4: Final Registration

If no opposition is filed within 90 days, the DOI issues the Trademark Registration Certificate. This grant provides protection for seven years, renewable every seven years.

3. Benefits of Trademark Registration

  • Legal Exclusive Rights: You have the sole right to use the mark for the registered classes of goods or services.
  • Brand Value: Registered trademarks are intangible assets that can be licensed, franchised, or sold.
  • Deterrent to Infringement: A registered mark makes it much easier to sue for damages if another business tries to copy your brand.

4. IP Law for Foreign Companies in Nepal

Foreign companies seeking to protect their brands in Nepal must register them locally through a licensed agent or lawyer. Nepal does not automatically recognize trademarks registered in other countries unless they are applied for under international treaties like the Paris Convention.
