In Nepal, marriage can be legalized through either traditional social customs or through Court Marriage (Civil Marriage). For many couples, especially inter-caste, inter-religious, or those involving foreign nationals, court marriage is the most secure and recognized legal path. 1. Legal Age for Marriage in Nepal

Under the Muluki Civil Code, 2074, the legal age for both men and women to marry is 20 years old. Marriage below this age is considered a criminal offense and the marriage itself can be voided.

2. Requirements for Court Marriage

To file for a court marriage in Nepal, both parties must meet several criteria:

  • Mutual Consent: Both parties must be marrying of their own free will.
  • Unmarried Status: Both parties must be single, divorced, or widowed (Bigamy and Polygamy are strictly prohibited and punishable by law).
  • Not Prohibited Relations: The parties must not be within the "prohibited degrees" of blood relationship.
  • Residence: At least one of the parties must have resided in the district where they are applying (e.g., Kathmandu) for at least 15 days.

3. The Registration Procedure in Kathmandu

Step 1: Filing the Application

The couple must file a joint application in the District Court. For many, this is the Kathmandu District Court or Lalitpur District Court.

Step 2: Documentation

You will need to provide:

  • Citizenship certificates (for Nepalese).
  • Passports and valid visas (for foreigners).
  • "No Objection Letter" or "Single Status Certificate" from the local ward office or embassy.
  • Recent passport-sized photos.
  • At least two witnesses with their identification documents.

Step 3: Verification & The 'Waiting Period'

The court will verify the documents. There is typically a brief waiting period (usually a few days to a week) after filing the application before the final ceremony.

Step 4: The Ceremony & Certificate

The judge will conduct the marriage ceremony in the presence of the witnesses. Both parties and the judge sign the marriage register, and the Marriage Registration Certificate is issued immediately.

4. Court Marriage for Foreigners in Nepal

Nepal is a popular destination for "Destination Weddings," but the legal part requires specific paperwork:

  • Affidavit of Eligibility: Foreigners must obtain a document from their embassy in Kathmandu stating they are legally free to marry.
  • Stay Requirement: The 15-day residence rule applies to foreigners as well.
  • Translation: Any foreign-language documents must be officially translated into Nepali.
